What to attach
- Copy of the OATH summons / Notice of Violation
- Photos of the cited condition (especially if cured or never present)
- Permits, COs, sign-off letters, prior-approved plans
- Affidavit if appearing by written submission
Pro tips
- OATH lets you submit a written defense without appearing. For routine DOB summonses this is usually optimal.
- Cure-and-cert defenses: provide before/after photos plus the AEU2 certificate of correction.
- A respondent can be the property owner, the contractor, or the tenant — make sure the respondent named on the summons is the proper party.
